Welcome to Peacock Films. By engaging our photography or filmmaking services through our website, WhatsApp, email, or any official communication channel, you (“Client” or “You”) agree to comply with and be bound by the following Terms & Conditions (“Terms”). Please review them carefully before confirming a booking.
1. Services
Peacock Films offers professional photography and filmmaking services including, but not limited to, weddings, pre-wedding shoots, events, portraits, and corporate assignments.
Details related to deliverables, inclusions, timelines, and pricing will be shared during the booking process or outlined in your confirmed quotation or invoice.
2. Booking Confirmation & Fees
A booking is considered confirmed only after receipt of the agreed advance payment.
Any remaining balance must be cleared as per the agreed payment schedule, typically on or before the event date.
Failure to adhere to payment timelines may result in delays or suspension of services or deliverables.
3. Client Responsibilities
To ensure smooth execution, the client agrees to:
Share accurate and complete event details including dates, timings, locations, and schedules
Obtain all necessary permissions, passes, or approvals required at the venue
Cooperate with the Peacock Films team during the assignment to achieve optimal results
4. Deliverables & Turnaround Time
Final photos and/or videos will be delivered based on the package selected.
Standard delivery timelines will be communicated at the time of booking and may vary based on season, workload, or project scope.
Delays may occur due to unforeseen circumstances, technical issues, or pending approvals or inputs from the client.
5. Creative Ownership & Usage
All photographs, videos, raw footage, and edited material remain the intellectual property of Peacock Films, unless otherwise agreed in writing.
Clients are granted a personal, non-commercial license to use the delivered content.
Peacock Films reserves the right to use selected images or videos for portfolio, promotional, website, and social media purposes unless the client submits a written request to restrict such usage prior to the event.
6. Cancellations & Refunds
The booking advance is non-refundable under all circumstances.
In case of cancellation by the client, the advance paid stands forfeited.
If the remaining amount has already been paid, the client may request rescheduling within 12 months from the original date, subject to availability.
In the rare event that Peacock Films is unable to deliver services due to unforeseen circumstances, a full refund of the amount paid will be issued within 30 days.
7. Delayed Payments
In the event of delayed or incomplete payments, Peacock Films reserves the right to:
Pause editing or post-production work
Withhold delivery of final outputs
Retain project data until dues are cleared
Terminate services if necessary
8. Rescheduling
Any request for rescheduling must be communicated in writing and is subject to availability. Rescheduling terms will align with the cancellation and refund policy shared at the time of booking
9. Limitation of Liability
While every effort is made to deliver high-quality work, Peacock Films shall not be held responsible for delays or disruptions caused by circumstances beyond reasonable control, including but not limited to natural events, accidents, venue restrictions, or technical failures.
Our maximum liability, under any circumstance, shall be limited to the total amount paid by the client for the specific booking.
If the client fails to complete payments or collect deliverables within a reasonable period, Peacock Films reserves the right to remove project data from storage after one year from the event date. After this period, we will not be liable for data loss or recovery
10. Privacy & Data Protection
Personal information shared with Peacock Films is handled in accordance with our Privacy Policy. While reasonable security measures are implemented, absolute security of digital data transmission cannot be guaranteed.
11. Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Any disputes shall fall under the exclusive jurisdiction of the courts of Mumbai, Maharashtra
12. Amendments
Peacock Films reserves the right to revise or update these Terms & Conditions at any time. Updated versions will be published with a revised “Last Updated” date.
